The Court of Appeal has handed Nairobi City County government the green light to expand after affirming that the city’s vertical growth can proceed under transparent, lawful and participatory planning frameworks. Delivering the Judgment on Friday, Justices Daniel Musinga, Joel Ngugi, and George Odunga opined that the 2004 zoning guidelines no longer bind the county. The appellate Judges have however ordered that the process must include public participation, with the court retaining supervisory jurisdiction to ensure compliance.
