The High Court has temporarily suspended the implementation of the new university funding model after the Kenya Human Rights Commission and three others challenged it on grounds that it the model is discriminatory and unconstitutional. While delivering the ruling Justice Chacha Mwita barred the Ministry of Education, Public institutions of higher learning as well as various State Agencies from implementing the new model.
