In a lecture at the University of Embu, Supreme Court Judge Isaac Lenaola defended Kenya's highest court, highlighting its vital role in preserving democracy. As part of the "Supreme Court at 12" commemoration, Lenaola discussed the Court's function in interpreting the Constitution, particularly Section 3 of the Supreme Court Act, which ensures impartial justice and upholds constitutional values.
Lenaola emphasized the strong connection between democracy and an independent judiciary, noting that the Supreme Court has played a transformative role in Kenya's post-2007 political landscape, especially after the 2017 ruling that annulled a presidential election. He clarified that the Court’s role extends beyond presidential matters, addressing issues in gubernatorial, parliamentary, and county elections, as well as gender equality in politics.
The lecture also covered judicial integrity in governance, citing the impeachment of County Governors and the importance of independent commissions like the IEBC in ensuring checks and balances. Lenaola condemned unconstitutional changes of government in Africa, stressing the judiciary's role in safeguarding free and fair elections.
In response to a petition to remove Supreme Court judges, Lenaola strongly defended the judiciary, warning that such efforts would weaken Kenya's democracy. He concluded by reflecting on Kenya’s progress since the 2007 violence, urging future lawyers to champion justice and constitutional integrity.
