The three Judge bench of the High Court has declined to recuse themselves from hearing the impeachment case filed by impeached deputy president Rigathi Gachagua. While giving the ruling Justices Eric Ogola, Anthony Mrima and Freda Mugambi said Gachagua has the right to appeal the decision if dissatisfied. The bench has at the same time directed parties to file their amended applications and set the case for hearing on Tuesday October 29th. And as Ruth Wamboi reports the Justice Ogola led bench cited that the recusal application did not meet the required threshold of the four grounds of recusal by Judges in a case.
